The law in Texas
DraftKings and FanDuel both offer salary-cap DFS in Texas, which has no law specific to DFS. A 2016 attorney general opinion said a court would likely find paid DFS to be illegal gambling. FanDuel paused paid contests in Texas in May 2016 under an agreement with the attorney general's office, but the major operators serve Texas today. Underdog, Betr and Dabble offer house-style pick'em, and PrizePicks and Sleeper run peer-to-peer versions. Players must be 18 or older.
Recent changes: July 2026: DraftKings and FanDuel dropped their lawsuit over the 2016 attorney general opinion. Both still operate in Texas.
