The law in Virginia
DraftKings and FanDuel both offer salary-cap DFS in Virginia. A 2026 law (HB 145/SB 129) moved fantasy contest regulation from the agriculture department (VDACS) to the Virginia Lottery, kept the minimum age at 21, and limits fantasy contests to players competing against each other rather than against the operator. The Lottery Board has until January 1, 2029 to adopt rules; until then, operators already registered with VDACS keep operating while the Lottery decides their permit applications. Pick'em here is mostly peer-to-peer (PrizePicks, Underdog, Sleeper and Betr); only Dabble still lists house-style contests.
Regulator: Virginia Lottery.
Recent changes: July 2025: the DFS age rose from 18 to 21. July 1, 2026: HB 145/SB 129 moved DFS to the Virginia Lottery, with a player-vs-player-only definition that rules out house-style pick'em. The Lottery hasn't adopted rules yet (its deadline is January 1, 2029), so VDACS-registered operators keep operating until their Lottery permits are decided.
